The water supplier SA “Apa-Canal Chisinau” will challenge the decision of the Chisinau Court of Appeals, by which it is obliged to cover the costs of installing water meters in the Supreme Court of Justice, Info-Prim Neo reports. According to a communiqué from the company, the dispute arose in February 2011 and concerns the implementation of the Law on Consumer Protection that does not clearly delimit the responsibilities of the supplier and consumers in the service provision process. Initially, the Chisinau Court of Appeals ruled in favor of SA “Apa-Canal Chisinau” and annulled the prescription under which the water meters were to be set up by the supplier. But the Competition Council appealed the decision to the Supreme Court of Justice. As a result, the case was remitted to the Court of Appeals for reexamination. “SA “Apa-Canal Chisinau” considers that the Court of Appeals’ decision is illegal and will soon challenge it to the Supreme Court of Justice,” it is said in the communiqué. According to the Competition Council, on February 21 the Chisinau Court of Appeals upheld the Council’s decision by which “Apa-Canal Chisinau” is obliged to install water meters to determine the volume of water consumed by end users using its own means.
