Company to pay over 60,000 lei damages to consumer

The Centru Court obliged a producer and a window fitter to pay over 60,000 lei in respect of pecuniary and non-pecuniary damages to a consumer for providing services of a poor quality to him, IPN reports.

Acceding to a communiqué of the Consumer Protection Agency, at the end of 2011, a person contracted a company to produce and set up PVC windows to the value of 4,300 lei.  The client shortly complained that the windows were installed inappropriately and the thermal insulation of the home was seriously affected. As the company did nothing to remedy the situation within 14 days, he filed a complaint to the Consumer Protection Agency, which ordered that the faults should be removed gratis. The company did nothing again.

The Agency, together with the consumer, filed a lawsuit. During the trial, the consumer changed his initial demands, when he requested the deficiencies to be removed, and asked for the equivalent value of the windows and for moral damages. The court ordered that the company pay a penalty of 10% of the price of the service for every overdue day.

The Consumer Protection Agency calls on the companies that receive petitions from consumers to pay increased attention to them so as to solve the existing problems by amicable ways and avoid incurring additional costs.
