The Constitutional Court declared the mandatory polygraph testing for occupying the post of president or vice president of the National Integrity Agency unconstitutional, IPN reports.

The Court pronounced following an application submitted by jurist Teodor Carnat, who challenged the legal provisions that oblige the candidates for president or vice president of the National Integrity Agency to take the polygraph test.

The invoked exception of unconstitutionality was analyzed through the angle of Articles 39 and 43 of the Constitution: the righto take part in the management of public affairs and the right to work.

Teodor Carnat ran for the presidency of the National Integrity Agency. He passed the written and verbal tests, but failed the polygraph tests. The Integrity Council announced a new contest without allowing this to be tested by an independent lie detector examiner.
