Judge to stand trial for passing illegal judgment

A judge from Chisinau was brought to justice for consciously passing an illegal judgment that had serious consequences. He faces three to seven years in jail and ban on holding particular posts or performing a particular activity for a period of up to five years, IPN has learned from the Prosecutor General’s Office.

On December 9 last year, the judge, examining the prosecutor’s request to extend the arrest warrant for a person accused of a very serious offense, evidently violated the procedure and, assuming the role of a common law court, ruled that the suspect’s actions didn’t contain elements of an offense and ordered that this should be set free in the courtroom.

The judge ignored the fact that the accused was investigated in other criminal cases started over similar offences and other accomplices of this at that moment were held on remand, based on decisions taken by the same judge.

The Chisinau Appeals Court accepted the prosecutor’s request, quashed the decision of the judge and extended the arrest warrant for the accused. However, the suspect fled Moldova in the period and was put on the wanted list.
