Legal Resources Center recommends optimizing courts of law

Reducing the number of courts of law and creating larger courts that would serve two-three districts are among the recommendations formulated by authors of a study carried out by the Legal Resources Center of Moldova. The study was presented in a roundtable meeting at the Ministry of Justice on February 12, IPN reports.

According to the study authors, the optimization of courts of law is necessary in order to ensure the quality of justice and the efficiency of the system. The larger courts may create a better work environment. The only argument against the closing of small courts is the fact that they are situated near local communities and provide easy access to justice. 

The study also presents the options of judges about specialization. According to the survey, 76% of the questioned judges consider that a specialized judge adopts better decisions than a non-specialized one. The specialization of judges can be implemented only in courts of law of an appropriate size.

Deputy Minister of Justice Nicolae Esanu told a roundtable meeting that the Ministry will analyze the recommendations of the study, but will not hurry things up so as not to hamper the implementation of new reforms.

Dumitru Visternicean, acting chairman of the Supreme Council of Magistrates, also considers that it’s not the case to hasten the optimization of courts and specialization of judges.

The study was carried out with financial support from the U.S. Department of State with the aim of assisting the authorities in taking decisions as regards the opportunity of optimizing the courts and implementing the specialization of judges in Moldova.
