The Superior Council of Magistracy gave the go-ahead to take legal action against the judge of the Rascani office of the Court of Chisinau municipality Oleg Melniciuc. The judge will be investigated for indicating false data in his income statement. For his part, Oleg Melniciuc intends to challenge the Council’s decision in the Supreme Court of Justice. The prosecutors also requested the Superior Council of Magistracy to suspend the judge from post, but this request was rejected, IPN reports.

“Under the law, it is the duty of the National Integrity Authority to identify inconsistencies in the income statement and only after the Authority does so it notifies the Prosecutor’s Office. In this case, I consider both the Prosecutor’s Office and the Superior Council of Magistracy undertook improper duties and I will thus challenge the decision,” stated Oleg Melniciuc.

The judge also said that he didn’t indicate false data in his income statement. He admitted that in 2013 he made a mistake as regards the cadastral number of a plot, but the income statement for 2016 was compiled correctly.

The judge is investigated in a case of unjust enrichment. At the start of last week, Oleg Melniciuc was arrested after it was determined that the value of his property is much higher than the legal incomes he declared. However, in 72 hours he was set free. The prosecutors didn’t ask for a warrant for the arrest of the judge because they believe there is no danger that this will influence the investigation.
