Rate at which justice reform is implemented is slow, experts

The rate at which the justice sector reform strategy is implemented remains rather slow. Such a conclusion was formulated in the presentation of the fifth quarterly monitoring report on the implementation of the strategy compiled by Promo-LEX Association and the Association for Efficient and Responsible Governance (AGER). The monitoring covered the period between January 1 and March 31, IPN reports.

In a news conference at IPN, AGER head Olesea Stamate said the progress made in implementing the plan of action continues to be insignificant. Of the 264 actions planned to be carried out in the first quarter of this year, 157 were implemented, while 107 were not. The ratio is thus 59%: 41%.

According to Olesea Stamate, though the ratio in percentage shows an increase compared with the previous report, the fact that few actions were planned for the period and weren’t even implemented is worrisome.

In the case of the strategy’s First Pillar (judicial system), eight of the 23 actions that weren’t carried out were to be implemented in 2012. The Second Pillar (criminal justice) contains 84 actions and 19 of them haven’t been implemented so far. The situation in the other pillars is much the same, stated Olesea Stamate.

The actions planned in the Seventh Pillar (coordination of the whole process) included the analysis of the powers of all the institutions involved in the implementation of the strategy, which was to be made in 2012. Based on this analysis, a number of changes were to be made to the institutions’ staff, the institutional capacities were to be adjusted, etc.

“I always had the feeling that this strategy is implemented with the closed eyes or ad-hoc, without preliminary planning. Things develop rather by inertia than based on good strategic planning,” said the head of AGER.

The monitoring centers on two basic components: fulfillment of the activities included in the plan of action for implementing the justice sector reform strategy, and monitoring of hearings. There were analyzed two categories of actions: actions planned to be carried out in the first quarter of this year and actions that were overdue at the end of last year.
