Two guards of Balti penitentiary convicted for using torture

Two guard of the Balti-based Penitentiary No. 11 were sentenced to eight years and six months in jail each for torturing a detainee. These were also banned from holding posts in penitentiary institutions during ten years, IPN reports.

The decision was taken by the Chisinau Appeals Court after the prosecutors challenged the judgment passed by the Chisinau Military Court, by which the two guards were acquitted.

The prosecutors proved that the two guards, on September 15, 2013, illegally used force against a detainee even if this didn’t put up resistance and had his hands behind his back, as required. It happened after the prisoner insulted the guardians. The detainee suffered medium bodily injuries, including severe physical and mental pain.

Recently, three employees of Penitentiary No. 13 of Chisinau were jailed for use of torture and inhuman and degrading treatment against two detainees. The prosecutors proved the blame of the employees after the same Chisinau Military Court acquitted these on all counts a year ago.

The Chisinau Appeals’ decisions are implementable, but can be appealed to the Supreme Court of Justice.
