Amendment changing procedure for electing CSM and CSP members adopted in final reading

Parliament adopted in the second and final reading an amendment that changes the procedure for electing members to the Superior Council of the Judiciary (CSM) and the Superior Council of Prosecutors (CSP).

In particular, if the General Assembly of judges or prosecutors did not take place due to a lack of quorum, a repeated assembly will be held within a limited time frame, and the quorum for it will be reduced to 1/3.

According to the Ministry of Justice, the amendment aims to avoid situations of perpetuating interim positions or vacancies on the CSM, the CSP and specialized boards.

The document regulates the situation when the General Assembly cannot be convened due to the term in office of CSM and CSP members expires, due to a lack of quorum or in the event of a state of emergency. If this happens, the General Assembly of Judges is convened and opened by the president or interim president of the Council. If that position is vacant, the General Assembly is convened and opened by the Minister of Justice.
