The judges who took decisions and the involved persons should pay damages, not the honest taxpayers, Minister of Justice Sergiu Litvinenco said, referring to the ECHR judgment in the case of Theo National Construct vs. the Republic of Moldova, which involved a Romanian road building and repair company. The ECHR held that the Moldovan judges committed abuses when examining the case. The minister said that he will notify the Prosecutor’s Office of this case, IPN reports.
Under the ECHR decision, in the case of the company based in Romania, the Moldovan judges manipulated the materials of the case, acting arbitrarily. As a result, the Republic of Moldova risks paying several million euros in respect of pecuniary damages.
Minister Sergiu Litvinenco said the ECHR judgment was adopted unanimously, which means that none of the seven judges had doubts about the text of the decision. This shows that an abuse was committed by the Moldovan judges. As the decision was unanimous, it is useless challenging it.
The minister noted that he will ask the Prosecutor’s Office to examine this case so that the judges to blame for this abuse pay the damages. The company’s lawyer Vladislav Gribincea earlier said that the president of the Social-Democratic Party of Moldova, businessmen Victor Shelin was involved in this scheme.
“I’m hopeful the prosecutors will probe the involvement of the former politician and of all the judges who adopted decisions and other persons concerned. Namely these persons, not the honest taxpayers, should pay for the caused damage,” Sergiu Litvinenco posted on his Facebook page.
