Bailiffs do not parasitize on public budgets, Bailiffs Union president

The president of the National Court Bailiffs Union Roman Talmaci replied to the statements made by the expert of the Association for Participative Democracy ADEPT Corneliu Gurin. “The bailiffs parasitize neither on the public budgets nor on the private ones. They only do their duty – forcibly implement court decisions and other orders,” he said. The reaction comes after the ADEPT expert leveled criticism at the court bailiffs in a news conference, Info-Prim Neo reports. In a statement, Roman Talmaci says the bailiffs take steps in accordance with the law, either complex or simple. Their final aim is to obtain the implementation of court decisions in the shortest period of time possible. Roman Talmaci also said that the size of the honorarium paid to the bailiff depends on the type of the document that is to be implemented and is levied obligatorily. “The method of levying the honorarium is described in Article 38 of the Court Decision Implementation Code. In this context, the National Court Bailiffs Union highlights that the honorarium is levied only in accordance with the law and exclusively in debt settling cases,” said the Union’s president. He also said that the bailiffs do not impose fines. “Mister Corneliu Gurin’s attitude is unclear. He criticizes the bailiffs, but defends the debtors, including the state institutions, which do not pay voluntarily the debts, ignoring the fact that owing to them Moldova is convicted by the ECHR and the people do not trust the national legal system,” it is said in the statement. Roman Talmaci requested Corneliu Gurin to inform the Union and the Disciplinary Board about cases when the bailiffs violate the deontological norms in order to avoid denigrating the whole system. The National Court Bailiffs Union of Moldova is a professional, nongovernmental, apolitical and noncommercial organization that aims to defend the honor and dignity of the bailiffs. Early in May, expert Corneliu Gurin told a news conference that the bailiffs turned into businessmen and parasitize on the budgets of the public authorities. The National Court Bailiffs Union expresses its regret at the fact that as an expert, Corneliu Gurin makes accusations about the court decision implementation process in Moldova without gathering evidence. The Union filed an application to court, asking that the media institutions that broadcast related information be allowed to reply.
