Call to responsible bodies and PGO over alleged illegalities against “Central House” SRL

The founder and ex-manager of “Central House” SRL Vitalie Perciun calls on the Prosecutor General’s Office (PGO) and all the responsible bodies to become involved given the illegalities and abuses committed against the Company. According to him, the Company, which in 2014 signed a lease contract with the state-owned enterprise “Gările și Stațiile Auto” (“Motor Terminals and Stations”, was forced to pay rental as if for areas even if it actually rents land. As a result, the rental is distortedly high. Moreover, the founder said that criminal cases were started unfoundedly and the taken measures blocked the Company’s activity.

In a press release, Vitalie Perciun says that under the contract that is valid for 49 years, the property was leased out with the aim of attracting investments for modernizing and renovating the adjoining territory, by erecting buildings, reconstructing platforms and repairing sidewalks so as to implement the European standards in the process of serving passengers. In 2014-2015, “Central House” SRL carried out works based on the contract, sustaining costs of 28 738 643.77 lei.

The former manager noted that after he made the investment and achieved the goal of the contract for the modernization of the Centru Motor Station, “Central House” SRL was forced to pay rental for the lot calculated for areas. “Central House” SRL was obliged to sign an additional agreement to the lease amid the pressure exerted by the lessor ÎS “Gările și Stațiile Auto”, represented by manager Vladislav Zara (current director of Public Services Agency) and vice director Iurie Moroz (current director of “Gările Auto Moderne” SRL), who have a concession over all the national stations.

Under the legal calculation formula, “Central House” SRL paid the lease for the lot for many years to come and asked that the rental should be set correctly. As this wasn’t done, in 2017 “Central House” SRL refused to recognize the bills of ÎS “Gările și Stațiile Auto” and the latter filed two lawsuits, to collect the rental, calculated for areas, since 2017 and to deprive “Central House” SRL of the right of ownership over the buildings erected by this in accordance with the additional agreement.

The Company’s assets valued at 60 080 000 lei in 2017 were sequestrated. The Company was banned from registering lease contracts even if the leasing out of commercial areas is the main activity that generates profit and helps the Company to recoup the made investments. The Company’s bank account was also sequestrated and payments to the national public budget could be made only through the bailiff, but this during four months hasn’t paid the outstanding debt, allowing it to rise owing to delay penalties. Bailiff Plămădeală Andrian unjustifiably withdrew over half a million lei from the account of “Central House” SRL and keeps it in his account, without paying the debts to the national public budget.

On June 5, 2020, the Public Services Agency managed by Vladislav Zara issued the decision to register the modifications of data in the State Register of Legal Entities by which Vitalie Perciun is removed as the manager of “Central House” SRL and another person is registered as manager.

A complaint about the misuse of authority by the registrar of the Public Services Agency was filed to Prosecutor General Alexandru Stoianoglo and the PGO on June 29. Vitalie Perciun said the decision to replace the manager was based on the proceedings of the General Assembly of Associates of “Central House” SRL that was signed by only one associate and on an own responsibility statement of the associate’s manager who said that he quoted by phone the associates of “Central House” SRL (four of the founders being from Azerbaijan). This is not true and the PGO was notified of falsification of statements. Under the law, the quoting can take place only by recommended letter. This way the registrar made the modifications by breaking the law.
