Parliament adopted the Democrats’ bill concerning the interpretation of the fiscal legislation for taxpayers, which provides the so-called anticipated individual fiscal solution, in the first reading on December 13, Info-Prim Neo reports. According to the initiator of the law, MP Andrian Candu, the implementation of the mechanism proposed in the bill will help the business community and the authorities alike. Under the bill, if a taxpayer does not know how to correctly interpret the fiscal or customs legislation concerning a certain situation or transaction, he can seek help from the competent body that studies the case in cooperation with him and afterward remits a letter that has the power of a law or of a contract for the given situation. Andrian Candu said that though the legislation must be implemented for the taxpayer’s benefit, in reality this is not so. According to the MP, such situations are presently managed by letters, but this is an inefficient model. In 2011 alone, there were about 1,400 such letters. In almost half of them the fiscal authorities did nothing but cite the law. Such mechanisms may be proposed for the customs and for the social insurance and health insurance contributions too. The bill was drafted following scandal about the German company Draexlmaier, about which the press said that was harassed by the fiscal service as a result of the different interpretation of the fiscal legislation.
