The decision passed by the Constitutional Court (CC) restored absolute normality when the parties are obliged, by the Constitution as well, to solve all the problems by political dialogue and reach a compromise if necessary, considers analyst Viorel Cibotaru.
“One way or another, it was one of the three decisions that the Constitutional Court could take. It was like a game of sport where you could put a bet. I think the situation is absolutely normal. The Constitutional Court had the possibility of adopting the hypercreative approach proposed by the Liberal Party, especially Victor Popa, who is the author of this approach,” Viorel Cibotaru stated for Info-Prim Neo.
The analyst believes that Moldova wouldn’t have coped with other challenges given the political context, where the PCRM plays a vital role and where there are certain approaches and mentalities. “We will now see what the political parties will do. They may try to come to terms and elect the head of state in accordance with the present Constitution or ignore the CC’s decision and choose another way. But this variant is highly improbable,” said Viorel Cibotaru.
He added that the main and simplest conclusion deriving from the Court’s decision is that the procedure for electing the head of state should be initiated immediately.
The Constitutional Court Tuesday ruled that the legislative body cannot institute another majority for electing the head of state by organic law when the Parliament is dissolved repeatedly following the non-election of the President. Thus, the head of state is elected by 3/5 of the votes of MP, i.e. 61 votes, in any situation.
