The Constitutional Court endorsed the bill to amend the Constitution’s article concerning the competence and structure of the CC following the Government’s challenge of November 28, IPN reports.
The bill ensures the right of the courts of law of all levels to notify the Constitutional Court to deal with exceptions of unconstitutionality.
As regards the structure of the CC, it is proposed that the number of constitutional judges should be raised from six to seven, while the seventh judge should be named by the Head of State.
As to the term in office of constitutional judges, it is suggested that this should be of nine years, without the right of renewal. The term of the constitutional judges who will hold office when the given law takes effect will be extended by three years, from six to nine.
The Constitutional Court ascertained that the bill to amend the Constitution does not violate the limits of the revision envisioned in Article 142 of the Constitution and can be submitted to Parliament for examination. However, the constitutional draft law can be adopted in at least six months of the day the proposal to amend the Constitution is presented.
