Constitutional Court rejects Mihai Godea’s challenge

The Constitutional Court rejected the challenge filed by the leader of the Democratic Action Party (PAD) Mihai Godea, who disputed the constitutionality of the laws by which the joint electoral system was abrogated, the election threshold was increased and the method of distributing the seats of MP was modified, IPN reports.

The Court decided that the setting of the representative threshold of freely cast votes in an election represents the exclusive prerogative of Parliament, while the implementation of the proportional electoral system does not run counter to the Constitution. Parliament has the freedom to decide the method of offering the seat of MP, the required voter turnout in any type of elections and the election validity conditions.

In a communiqué, the PAD says that they will not comment on the Constitutional Court’s decision, but the party will continue to pursue the goal of guaranteeing the constitutional right to free and fair elections of the Moldovan people. According to the PAD, this right is flagrantly violated by the amendments that were recently adopted by the PCRM and PLDM.

Earlier, the party said that based on the amendments made to the Election Code, the election runners will be able to make any changes in the electoral rolls with no restriction. Thus, it can happen that by the election day the list of candidates will be completely modified. The PAD considers that this fact seriously affects the principle of direct and free voting.
