The Buiucani office of the Court of Chisinau municipality will request the Constitutional Court to pronounce on an exception of unconstitutionality in the case of ex-MP Kiril Luchinski. The judges partially accepted one of the requests made earlier by the lawyer for the former MP Corina Stratan, IPN reports.

After the October 19 hearing, Corina Stratan told the press that the prosecution accuses Kiril Luchinski of using ill-gotten gains to which the accused should have admitted, but the Penal Code does not specify such a form of accusation.

The lawyer also said that under the law, when the CC is requested to pronounce on the exception of unconstitutionality, the trial is suspended until a judgment is passed. But their relevant request was rejected and an irrevocable decision was issued in this regard.

Kiril Luchinski said the refusal to suspend the trial is illogical and illegal.

Kiril Luchinski was arrested on May 25 this year and was then placed under house arrest. The ex-MP is accused of money laundering and violation of the regime of declaring property for the reason that he didn’t indicate he is the owner of a company that was allegedly involved in the banking frauds at Banca de Economii, Banca Sociala and Unibank. On October 17, the court extended his house arrest for 30 days. Kiril Luchinski pleads not guilty.
