Database of non-paying economic agents to be created

The list of economic agents with debts will be published on the MConnect interoperability platform. The platform will contain data on both debts to the State Tax Service and those resulting from court decisions. This is provided in a draft law that was given a first reading by Parliament on Thursday, IPN reports.

The platform will also allow economic agents to report bad payers with whom they have commercial relations. This information will have to be substantiated and the reporting person will take responsibility for the information submitted. In this way, the authorities aim to ensure transparency and predictability in the process of making payments in commercial transactions.

The bill was drafted by the Ministry of Economic Development and Digitalization and transposes into national legislation the provisions of the Directive of the European Parliament and of the Council on combating late payment in commercial transactions.

According to the authors, regulations are necessary because, although goods or services are provided, many invoices are paid long after they are due. This affects the liquidity of economic agents, as well as the competitiveness and profitability of companies, since the lender has to obtain external financing due to late payments. Currently, there is no special law on combating late payment in commercial transactions.

The draft law also refers to liquid and payable receivables resulting from the obligations to pay sums of money, based on a contract concluded between professionals or between professionals and contracting authorities. They have as their objects the supply of goods, execution of works or provision of services, including the design and execution of public works, buildings and civil engineering works.

The authors of the document also propose a payment term between professionals of no more than 60 days, in order to ensure a predictable and fair framework for both parties. At the same time, in the case of contractual relations between professionals and contracting authorities, it is proposed that the legal payment term should not exceed 30 days.

The legislative initiative is to be given a final reading.
