Acting Minister of Justice Oleg Efrim ordered instituting disciplinary proceedings against seven judges involved in the case of the state-run document issuing company “Registru”, which is to pay almost US$8 million damages to the foreign firm “Intercomsoft LTD”, IPN reports.

According to a communiqué from the Ministry of Justice, as a member of the Supreme Council of Magistrates, Oleg Efrim established that the decision of the court of appeals and that of the supreme court in the case of IS “Registru” versus “Intercomsoft LTD” were passed with serious violations of the legal norms.

Oleg Efrim sent the materials concerning the Chisinau Court of Appeals judges Anatolie Pahapol and Anatolie Minciuna, and the Supreme Court of Justice judges Svetlana Filincova, Svetlana Novac, Tatiana Vieru, Iurie Bejenaru, and Galina Stratulat to the Disciplinary Board of the Supreme Council of Magistrates for examination.

In its communiqué, the Ministry says that the contractual relations between “Intercomsoft LTD” and IS “Registru” were ended in 2006. As no new agreement was signed, the parties cannot be forced to provide certain services. Under the contractual obligations, the right to examine disputes does not belong to the national courts. This fact was confirmed by the decision of the International Arbitration Court under the Chamber of Industry and Commerce of Paris. By the Supreme Court of Justice’s decision of April 24, 2013, the decision of the Chisinau Court of Appeals, which obliged IS “Registru” to pay damages of US$7.8 million to “Intercomsoft LTD”, was upheld.
