Domnica Manole: Superior Council of Magistracy committed an abuse

The Superior Council of Magistracy committed an abuse, flagrantly violated the legislation and exceeded its authority when it decided to dismiss judge Domnica Manole from the system, the ex-judge stated in the talk show “Expertise house” on Jurnal TV channel, IPN reports.

Domnica Manole said that even if the Council should have examined only the appraisals of the Security and Intelligence Service, the decision also contained information about the identified disciplinary deviation, arbitrary accusations about which she wasn’t informed. “I was sentenced without being accused as I didn’t know what everything was about,” she stated.

The judge noted that the Constitutional Court’s judgment whereby the Superior Council of Magistracy’s decision to remove Domnica Manole from the system was declared unconstitutional said it very clearly that the SIS appraisals based on which the judge was dismissed were a political weapon against judges and a method of getting rid of judges who were inconvenient for the power.

Judge Gheorghe Balan said the SCM knows to adopt decisions to the detriment of judges. He was also wronged by the Council’s decisions. “Missis Manole should be glad that she wasn’t reinstated by a decision of the SCM as the quality of this institution leaves much to be desired,” he noted.

Legal Resources Center adviser Ion Guzun said this case is to be examined more thoroughly. “The case of judge Domnica Manole should be analyzed in a much broader context,” he stated.

In its February 6 meeting, the Superior Council of Magistracy unanimously rejected Domnica Manole’s request to be allowed to return to the legal system.
