ECHR exempts Moldova from paying over €7m damages to private company

The European Court of Human Rights (ECHR) passed a just satisfaction decision in the case of Norma S.R.L. versus Moldova. Thus, Moldova was exempted from paying about €7.2 million asked by the plaintiff and was obliged to pay only €1,200 in respect of non-pecuniary damage, IPN reports, quoting the Ministry of Justice.

Norma S.R.L. asked for €7 171 653 in respect of pecuniary damage that represents the estimated income and related overdue interest rates. The sum was determined based on a report compiled by the National Center of Legal Examinations of the Ministry of Justice (period 10.06 – 10.09 and overdue interest for 01.11.09 – 31 01.12).

The company also claimed €10,000 from the Moldovan state in respect of non-pecuniary damage sustained while didn’t working, during a period of four years. The Government decided that this sum is excessive and unfounded.

The applicant also claimed compensation in the amount of €4,253 for the costs incurred when compiling financial reports on the sustained pecuniary damage. The Government classed this request as groundless, while the ECHR held that the company is entitled to a refund only if it is proven that the costs were necessary.

The ECHR decided that Moldova will pay €1,200 in respect of non-pecuniary damage to Norma S.R.L. and dismissed the other just satisfaction claims.

The Ministry noted that on May 20, 2015, the Extended Civil, Commercial and Administrative Claims Board of the Supreme Court of Justice quashed the decision based on which the state was to pay 26 393 880 lei in respect of pecuniary damage, 16 000 lei in respect of non-pecuniary damage, 4 120 lei court costs and the state tax of 50 000 lei to the complainant company and remitted the case to the Cahul Appeals Court for reexamination.
