Igor Dolea had dissenting opinion in Muruianu case

Igor Dolea, member of the Superior Council of Magistrates, had a dissenting opinion regarding the invalidation of the disciplinary sanction against Ion Muruianu, the chairman of the Supreme Court of Justice.
“Unfortunately, I don’t share the opinion of the majority that SCM's only mission was to determine the legality and opportunity of that sanction, without pronouncing on certain principles, the denial of which can have harmful consequences for the judiciary and, and in particular for society”, Igor Dolea said in a statement published on Tuesday, June 29.
“Naturally the SCM should not interfere in the act of administering justice. However, when certain principles are infringed, the Superior Council of Magistrates cannot and mustn’t remain a passive observer, considering the responsibility entailed by the act of justice”, he argues.
On June 22, the SCM reversed the Disciplinary Council’s decision which proposed Muruianu’s dismissal.
