A judge and a clerk of the Rascani Court weren’t penalized by the Disciplinary Board of the Superior Council of Magistracy even if they committed irregularities. Such accusations were made by the director of the limited liability company Juststudiumanima SRL Igor Blanari.
In a news conference at IPN, Igor Blanari said that as a result of a dispute with a company, he lost the case in court because the case examination and decision editing deadlines weren’t met.
Consequently, Igor Blanari informed the Disciplinary Board of the Superior Council of Magistracy, asking to investigate the case and penalize the judge, who, he considers, seriously violated the procedures because he had an interest in this case. The petitioner also asked that the common law court should be obliged to edit the decision.
After the Judiciary Inspection carried out inspections, it compiled a report and presented it to the Admissibility Board of the Council’s Disciplinary Board, which rejected yet the application submitted by the representative of Juststudiumanima SRL.
According to Igor Blanari, the Admissibility Board’s decision is very vague and has no legal basis.
“We all know that any deviation should be penalized... In our system, things stand differently. When you say what the law provides or at least how some general norms should be respected, you are clearly suggested that you are the “worst”,” said the director of Juststudiumanima SRL. “In the Moldovan system, those who report deviations are the “worst”.
