A judge from Orhei is accused of examining the complaint of an economic entity with deviations from the legislation. The Anticorruption Prosecutor’s Office sent to court the criminal case started against the judge, IPN reports.
The prosecutors established that the accused ignored the provisions of Article 313 of the Code of Penal Procedure, which stipulates that the complaint is examined within ten days. However, the judge examined the petition in over five months.
It was also established that initially the judge rejected the economic entity’s complaint about the annulment of the ordinance not to take legal action and to drop the case. However, in the final written variant of the judicial act, the judge admitted partially the petitioner’s complaint, nullifying the ordinances not to take legal action and to reject the petitioner’s complaint made by the prosecutor’s office, ruling that the judgment becomes irrevocable when it is passed.
The unprofessional conduct carries a fine of up to 16,000 lei or up to five years in jail, in both of the cases with the deprivation of the right to hold particular posts or to perform particular activities for a period of up to five years.
