Modifying the laws without reasoning the need jeopardizes stability of the legal framework, opines the chairman of the Judges Association from Moldova, Tudor Popovici. “When the laws are hastily modified, havoc starts in society, the judiciary's credibility and will vanishes,” he stated Thursday at an international workshop on the independence of the judiciary.
According to Popovici, the laws are often modified without explaining the need to do so.
“The laws we boasted to have adopted in accordance with the European standards suffer from intense interventions. It's impossible to cope with the avalanche of modifications. They laws should stay as adopted some 2-3 years,” the judge has said.
“A judge has to permanently read Monitorul Oficial (Official Gazette) to watch if modifications are or are not operated to some laws,” he has told Info-Prim Neo.
According to Tudor Popovici, the non-grounded modifications are operated because there are too few juridically-minded parliamentarians in Moldova, when compared to other countries.
Attending the event, Mihai Poalelungi, a judge with the European Court of Human Rights, has said things are more intricate now. “During the Soviet era, the cases were much simpler, the laws were much clearer. Now we have to consult both the national and the international laws,” he said.
