The judges ask amending the legislation so that they are not obliged to provide explanations over all the decisions they pass as they have too many trials and this will make their work easier and more efficient, Info-Prim Neo reports.
A legislative initiative to this effect was examined by the legal commission for appointments and immunities. Deputy Minister of Justice Vladimir Grosu said the initiative was risky. “From my experience at the ECHR, I know that it is risky to abandon writing the explanatory part in certain cases. No country has such a practice. Everywhere the judge pronounces judgment and explains it. We understand that the judges have a heavy workload and suggest that they should be given 15 days to prepare the explanatory side,” stated the deputy minister.
Vladimir Grosu also said that every person has the right to know why a certain decision was taken. There is chaos now in courts. The explanatory part is sometimes provided with a delay of several months or even half a year.
According to the judges attending the commission’s meeting, a judge has to examine up to 20 cases a day.
