The right to examine the judicial cases will be transferred from the specialized institutions like the economic and military courts to the common law courts. Relevant amendments to a number of laws were approved by the Government at its last meeting, Info-Prim Neo reports.
Minister of Justice Alexandru Tanase said that the modifications are aimed at ensuring the independence of the legal system and the observance of the human rights. He said that the specialized courts showed their inefficiency in the course of time.
“The economic matters examined by the economic courts and the Economic Court of Appeals are just a component part of the civil law so that a civil law judge will not meet with difficulties when dealing with a commercial issue,” Tanase said. As to the cases examined by the military courts, the minister said that they are different only by the subjects who committed the offenses.
“The argument that these cases can constitute state secret and cannot be examined by common law courts is groundless as some of the cases can be examined by these courts at closed meetings,” Alexandru Tanase said.
The amendments represent a first step aimed at liquidating the specialized courts.
