The transition to the institute of private court officers could last up to one year, but preparations for this reform could be completed already by the end of this year, Justice Minister Alexandru Tanase Has told Info-Prim Neo. According to him, the reform aims to fortify the system of enforcing court decisions, which will lead to fewer complaints.
“The current mechanism is not effective simply because the government doesn't have money to finance it as it should be financed in order to execute any court decision. This is exactly the reason why we'll exclude the formula where the government is responsible for the enforcement of judgments and choose instead the solution of private bailiffs, exactly as it happens in most European countries, following the example of the private notaries”, explained the minister.
The minister highlighted the economic advantage of the reform: first, the government will not spend money on maintaining court officers and, second, once they become private, the bailiffs will pay taxes.
Tanase said the private bailiffs will most probably be able to set fees for their own. They will also need a license from the Ministry of Justice to practice and they will be subjects to control from the government, like the private notaries.
“A professional entity will be set up, let's say the Bailiffs Chamber, which will have a code of conduct, a disciplinary commission, and will supervise the observance of the ethic standards”, said Alexandru Tanase, adding “It is a good practice that works well all over the world and will work well here, too”.
A draft law to initiate the reform will be shortly submitted to Parliament for consideration.
