Justice Ministry requests examining legality of property earned while holding public posts

Minister of Justice Oleg Efrim asked the Constitutional Court to determine if the civil servants benefit from the same protection degree as the people as regards the presumption of the illegal character of the property earned while holding public posts, Info-Prim Neo reports, quoting a communiqué from the Ministry. “In order to ensure an efficient fight against corruption, the state must have effective mechanisms such as institutions outfitted with legal instruments for combating corruption. The rigid interpretation of the given constitutional norm hinders the use of efficient instruments for identifying, investigating and penalizing cases of corruption, which are successfully implemented in other countries,” says the Ministry. It also says that the systemic interpretation of all the constitutional provisions does not confirm that the rigid interpretation renders exactly the meaning stipulated in the Constitution. Depending on the solution proposed by the Constitutional Court, the Ministry of Justice will start to formulate new regulations so as to provide the state institutions with efficient and sufficient instruments for fighting corruption.
