Owner of peasant farmstead says she is victim of court abuses

Alexandra Rusu, the owner of a peasant farmstead situated in Jora de Jos village of Orhei district, alongside members of an association, said that she is the victim of court abuses. The woman noted that during many years they have been robbed of property under the protection of judges in Orhei and Chisinau. She called on the senior administration and on the Superior Council of Magistracy to intervene and help her obtain justice.

In a news conference at IPN, Alexandra Rusu said that they created an association whose members contributed by 17,000 lei each for setting up a plantation. Since 2014, they have been in litigation. Everything started from the purchase of a 1 ha lot that in reality was sold to a number of persons. The illegalities were committed by employees of the Cadastral Office who continue to hold their posts.

Alexandra Rusu said that the Orhei Court and the Appeals Court ruled in her favor, but the Supreme Court of Justice sent the case back for retrial for three times already even if they have three contracts and three expert appraisals. Due to uncertainty and the lack of a final court judgment, the peasant farmstead sustains losses of about 1 million, while the land is not cultivated. 

Besides, in November 2017, a farmer claimed over 1.5 million lei from her after she was unjustly accused of stealing over 100,000 trees. She was sued even if there is no document ascertaining the theft. Consequently, a judge from Orhei decided that she should pay over 800,000 lei.

The owner of the peasant farmstead challenged the decision of the ordinary court. In the Appeals Court, she had to pay the state tax of 18,000 lei. This was money she was gathering for her husband’s surgery. She hoped the court will rule in her favor, but this sent the case to the first court for retrial.

The woman said she annually pays 100,000 lei taxes to the state, but this does not defend its citizens. She is ready to sleep on the stairs of the Presidential Palace if justice is not done to her.

Ion Gondiu, a member of the cooperative, said that owing to the legal proceedings, the people cannot cultivate the land, including the lot that someone tried to steal, and therefore all the families that invested money suffer losses.
