The Communist Party (PCRM) exerts political pressure on the Constitutional Court, considers the Democratic Action Party (PAD). Related statements were made after the Court ruled that the legislation on the liquidation of economic and military courts was unconstitutional, following a challenge filed by the PCRM, Info-Prim Neo reports.
The PAD subscribes to the opinion that the Constitutional Court passed the decision by neglecting or tendentiously interpreting the provisions of the supreme law. It considers that the Court’s intervention obstructed the implementation of the justice sector reform planned in the government program, which was launched with difficulties, but was close to being applied, the party says in a statement.
The Democratic Action Party notes that the decision was pronounced at the end of the period of applying the given law and reform, not long before the completion of the transitory stage and after a rather long period within which the new regulations were implemented. “The Court’s belated intervention and the creation of procedural shortcomings in the functioning of the courts by such a decision shows that the principles of stability and predictability of the legislation, which are aimed at strengthening the state of law and that must guide all the state institutions, are no respected,” reads the statement.
The party called on the Constitutional Court to reexamine the decision taken on February 9 and show by its decision that it obeys the Constitution and the principles of the separation of powers. It also asked the representatives of the political power and the government to intervene and take firm measures so as to prevent the interference by public or private institutions in the mechanism for exercising power.
