The Center for Reform in the Judicial System suggested creating a specialized court that would examine cases of corruption and related cases by reorganizing or based on the personnel units and material assets of the Military Court. Such a measure would contribute to unifying the judicial practices as the courts continue to erroneously and uniformly interpret the criminal law norms concerning acts of corruption and to individualize punishment, IPN reports.
In a communique, the Center says the legislative, institutional and judicial practice unification measures taken until now cannot produce the expected results in the absence of specialized judges who would deal with cases of corruption. A specialized Appeals Court should be also created to examine cases of corruption and related cases by reorganization or based on the personnel units and material assets of the Chisinau Appeals Court.
A specialized board or panel is needed at the Supreme Court of Justice to deal with the appeals regarding cases of corruption and related cases, while the specialized judges should be named to posts only after a selection that would exclude risks of corruption, including their voluntary testing, on the polygraph.
The Center considers the judges should specialize in the examination of corruption offenses and related ones, while the cases should be concentrated in the hands of a small circle of specialized judges so as to ensure consistency in decision-making and a common practice.
For the purpose, the Center for Reform in the Judicial System decided to draft a package of legislative proposals concerning the specialization of judges in the examination of cases of corruption and related cases and the creation of specialized courts. Given the importance and complexity of this issue, it asks those interested to send their opinions to the email addresses of the Supreme Council and Magistrates and the Supreme Court of Justice - aparatul@csm.md and info@csj.md.
