Tour operators will be obliged to possess guarantee fund

The Tourism Agency has launched the process of working out the mechanism for implementing the Civil Code article concerning the guarantee. Under the main amendment, the organizer must provide guarantees that the amounts paid by the tourist will be refunded in case of insolvency and that this will be repatriated, IPN reports.

Representatives of the Tourism Agency, the Ministry of Justice, the Ministry of Economy, banks and insurance companies discussed the amendments that are to be made. The meeting was also attended by representatives of the National Tourist Office of Romania, who came at the request of the Tourism Agency to provide logistic support. The debates centered on the identification of an efficient mechanism that would protect the consumers and would not have a major negative impact on the business community. There were enumerated different instruments such as the insurance policy issued by insurance companies, a possible guarantee fund for tourism operators and travel agencies, the bank guarantee, the fiduciary code and the possibility of using companies’ assets as guarantee.

At the end, it was decided to agree 2-3 instruments for implementing the provisions of the Civil Code. The Tourism Agency of Moldova, with the support of the Romanian National Tourist Office, will additionally examine the legislation of the EU and will identify a solution for Moldova.
