Two police officers were obliged to pay about 50,000 lei damages to the state for using torture and violating the rights to freedom and safety of a person in April 2009. The judgment was passed by the Ciocana court of Chisinau and can be appealed by November 9, IPN has learned from the Ministry of Justice.
In 2009, the two police officers held a person on remand for five days. Later, this person complained to the ECHR about illegal detention and inhuman and degrading detention conditions in remand prison. The Court ruled in his favor and awarded him 50,000 lei damages that were paid from the state budget of Moldova.
The Ministry of Justice requested the Prosecutor General’s Office (PGO) to determine if the actions of the two policemen represented constituent elements of an offense and to oblige these to repay the damage caused to the state, in accordance with the decision of the Supreme Court of Justice.
Head of the Ministry of Justice’s Protocol, Information and Mass Media Service Rodion Gustiuc said that 19 civil lawsuits have been filed since 2008, according to the PGO data. Twelve of these were accepted. Definitive and irrevocable decisions were passed in ten cases, while another two are pending. Two of the cases involve by two police officers. Rodion Gustiuc could not say if these continue to work.
