Venice Commission asked to pronounce on inclusion of prosecutor general in SSC

The Prosecutor General’s Office requested the Venice Commission to state its opinion and to issue the Moldovan authorities with its conclusions concerning the admissibility of the prosecutor general’s participation as a member in such a body as the Supreme Security Council (SSC) from the angle of the Moldovan legislation, IPN reports.

In a press release, the PGO says that in addition to the materials sent earlier to the Venice Commission, it also made a special request to formulate an expert opinion on the compatibility of the legislative changes made recently to the law on the prosecution service, following the reforms announced by the parliamentary majority, which, by the content and flaws of the lawmaking procedure, imply the risk of political interference in the activity of the Prosecutor’s Office and creates preconditions for serious meddling in the ensuring of the principle of independence of prosecutors at national level.

“The PGO requested the Venice Commission to also pronounce on the inadmissibility of political pressures on the institution, given the arguments that explain the risks of the disloyal political behavior and the negative impact of the lack of honest cooperation on the separation of powers in the state,” noted the institution.

The Prosecutor General’s Office expressed its disagreement with the way in which the amendments to the law on the prosecution service were examined and adopted, saying these risk generate effects that seriously affect the constitutional principles concerning the independence of the prosecution service and separation of powers in the state, undermining the independence of prosecutors to the advantage of the political factor.
