Any further action on Moldtelecom tariffs depends on ANRCETI, says competition chief
Any further action by the National Agency for Competition Protection (ANCP) in the case of Moldtelecom's tariff measure depends on whether or not the Regulatory Agency for Information and Communication Technologies (ANRCETI) finds that Moldtelecom has retained its dominant position on the market, stated ANPC director Viorica Carare at a press conference on Tuesday.
“When we have ANRCETI's decision, we will have a legal ground to continue the investigation”, she said.
Viorica Carare recalled that ANPC twice requested ANRCETI to examine Moldtelecom's position on the market, the first time in August 2010 and then in January 2011, but no answer has been given so far.
According to the 2008 Electronic Communications Law, ANRCETI is required once in two years to present an analysis of the relevant markets and update the information. Moldtelecom's dominant status had been established by ANPC in 2007, but this finding has no juridical effects now as the legal framework has changed.
Earlier today ANRCETI said that in 2-3 months it would finalize the procedure of assigning the status of service provider with significant market power to Moldtelecom, and then would adopt, in consultation with the Government, the tariffs of fixed-line telephony services provided by Moldtelecom.
Moldelecom's decision to raise the rates of fixed-line calls was supposed to become effective from March 1, before being suspended through a cease-and-desist order issued by ANPC.
