The Chisinau Appeals Court rejected the appeals of Adrian Nichifor’s lawyers as groundless, upholding the previous decision by which he was sentenced to 17 years in jail. The Court yet accepted the prosecutor’s appeal in the case of Nichifor’s nephew Trofim Nichifor, who was earlier acquitted, IPN reports.
The Prosecutor General’s Office reminds that on April 11, 2010, Adrian Nichifor came into conflict with brothers Iurie and Lilian Parlici near a bar in Grozesti village, as he didn’t like where they parked their car. Phoned by Adrian Nichifor, his nephew Trofim Nichifor came shortly to the bar, bringing a gun. Adrian Nichifor fired five shots at Iurie Parlici, injuring him fatally.
On June 20, 2011, the Ciocana Court found Adrian Nichifor, 40, guilty of aggravated hooliganism and intentional murder, sentencing him to 17 years in jail. By the same sentence, the prosecution of Trofim Nichifor, 24, for bearing and keeping firearms and ammunition without authorization was stopped, while on the count of offense favoring he was acquitted.
The Chisinau Appeals Court upheld the decision of the first court regarding Adrian Nichifor and passed a new judgment in the case of his nephew, the young man being found guilty on both counts. He was also fined 18,000 lei.
The decision can be appealed to the Supreme Court of Justice.
