Bailiffs will be fined for breaking terms
The bailiffs will be fined if they do not fulfill the procedures in due time and will be obliged by law not to avoid implementing 'non-attractive' court decisions, like those concerning forced reinstatement in the post, confiscation of the salary for not going to work and others. This is provided in the amendments to the Enforcement Code approved by the Government, Info-Prim Neo reports.
Minister of Justice Alexandru Tanase said the amendments are aimed at reforming the system of implementing court decisions and making the current enforcement mechanisms more efficient, changing the status of the bailiffs, and shifting from state bailiffs to private ones.
Under the new norms, every private bailiff, after the implementation of the reform, will work in a certain district, but will be able to enforce decisions and follow units of transport and budgetary resources indicated in the decisions in any part of the country.
The enforcement costs will consist of taxes for implementing court decisions, expenses related to the enforcement procedures and the honorarium. The taxes will be set by Government decision. The honorarium will be paid to the bailiff when a court decision is fully or partially implemented.
The honorarium will depend on the size of the debt cleared – the larger the sum, the lower the percentage for the honorarium.
Under the amendments, the bailiff is not allowed to suspend a court decision and limit the length of an enforcement procedure - from immediately to the maximum period of 15 days. If the implementation of the decision is delayed, the bailiff will be fined 200 lei for every delayed day.
