The Constitutional Court (CC) endorsed the Government’s bill to amend the Constitution’s provisions concerning affiliation to trade unions. Thus, the bill can be submitted to Parliament for consideration, IPN reports.
According to the CC, the bill amends Article 42 of the Constitution and broadens the forms of association. “Currently, Article 42 of the Constitution stipulates only affiliation to trade unions. In its case law, the Court, based on Article 4 of the Constitution, which says that the human rights and freedoms are interpreted and applied in accordance with the treaties to which Moldova is a party, examined the right to association in its broad meaning,” said the CC president Alexandru Tanase.
The Court allowed to amend the first paragraph of Article 42 and to exclude the second paragraph. The first paragraph will say that any person has the right to freely associate themselves with other persons, including to found trade unions or employers’ organizations and join these.
The bill can be adopted in at least six month of the submission to Parliament.
