Vladimir Țurcan’s application to review the decision by which he was removed from the post of Constitutional Court president was dismissed as inadmissible, as was his application to review the decision by which Domnica Manole was elected president of the Court, IPN reports.
Under the CC’s judgment, the post of president of the Constitutional Court is not guaranteed by the status of constitutional judge. This post is a “mandate” entrusted by the plenum of the CC and this can be withdrawn by the same procedure by which it is offered.
The CC held that the keeping or dismissing of the President from the post is related to the sovereign character of the Court, which decides based on the state interests, offering a constitutional law interpretation. The Court makes reference to the arguments on which the dismissal on based, namely the discussion of Vladimir Țurcan and President Igor Dodon.
“Taking part in the plenary meeting, the president of the Constitutional Court Vladimir Țurcan confirmed the public statements and repeatedly maintained that the discussion with the Head of State was purely informative in character and they didn’t speak about who and how voted in deliberations. He also said that in the meetings he had with the President, he never discussed the jurisdictional activity of the Constitutional Court,” said the Court, concluding that the President’s assertions were made knowingly and based on appropriate information.
The CC also said that judge Vladimir Țurcan behaved in a way that does not exclude the exertion of influence on him and didn’t ensure the keeping of the secrecy of the votes.
Ex-Socialist MP Vladimir Țurcan, who was named constitutional judge by Parliament, was elected president of the CC on August 19, 2019. A decision published on the CC’s website on April 23 this year says that Vladimir Țurcan was dismissed as president of the Court following a vote of no confidence. Another decision says Domnica Manole was elected CC president by secret ballot for a three-year term, by a majority of votes.
