Constitutional Court rejects Government's challenge

The Constitutional Court rejected the challenge, asking that Alina Ianuchenko be withdrawn from the panel of judges that will examine the PCRM's proposal for modifying article 78 of the Constitution concerning the election of the head of state. The challenge was filed by Deputy Minister of Justice Gheorghe Susarenko, the Government's representative at the court, Info-Prim Neo reports. Gheorghe Susarenko argued that the term in office of Alina Ianuchenko expired. She was appointed to post on April 23, 2004 for a six-year period. “The tacit extension of the term is against the law,” said the Deputy Minister of Justice. After deliberations, the president of the Constitutional Court Dumitru Pulbere announced that the challenge submitted by the Government's representative was rejected. ”A judge takes up the duties after the swearing in ceremony. Alina Ianuchenko was sworn in on May 14, 2004. So, her term in office expires on May 14, 2010,” Dumitru Pulbere said. The Constitutional Court came together for a meeting on April 29 to examine the constitutional amendment proposed by the parliamentary group of the Communists Party. The Communist MPs suggest holding three rounds of presidential elections in Parliament, not two as at present, and electing the President by 61, 57 and 52 votes respectively. The Alliance for European Integration wants the head of state to be elected directly by the people. The Alliance's proposal will be examined by the Constitutional Court on May 4.
