Draft law on public prosecution approved by Cabinet

After prolonged debates and delays, the Government on Wednesday, November 26, finally approved the draft Law on Public Prosecution, which aims to adjust the activity of the Prosecutor General's Office to the Moldova-EU Action Plan, Info-Prim Neo reports. Attending the Government's meeting, Moldova's Prosecutor General Valeriu Gurbulea said the draft embodied the domestic particulars as well as legal standards applied to the activity of the public prosecution bodies in other countries. According to the bill, the main duty of the Prosecutor General's Office is to conduct criminal proceedings and represent the state in court. The prosecutors are to establish self-governing bodies, among which the Superior Persecution Council and disciplinary and qualifying boards. In Gurbulea's opinion, these will consolidate the principles of independence of the prosecution, in particular owing to the fact that a series of powers of the Prosecutor General concerning disciplinary and career matters will be delegated to these collective bodies. The draft also contains a series of principles meant to strengthen the independence of the prosecution as an institution involved in enforcing criminal justice. The adoption of this law is among the commitments assumed by Moldova at the Council of Europe.
