The European Court of Human Rights (ECHR) found Moldova guilty of infringing SA Ipteh's rights to property and fair remedy. The Court's decision on the case of SA Ipteh and its shareholders against Moldova was made public at a news conference on November 24, Info-Prim Neo reports. The company's shareholders complained to the ECHR after the Prosecutor General's Office sent to court a case concerning the purchase by SA Ipteh of a building located on 65 Stephan the Great Blvd. in 1999. The court annulled the privatization and nationalized the building. Given the gravity of the violations and the possible political implications, the ECHR examined the case as a n emergency. It offered the plaintiffs three months to file applications, asking for damages, or to reach am amicable settlement with the Government. Janeta Hanganu, the lawyer for SA Ipteh, said the nationalization was illegal as the Prosecutor General's Office initiated the process nine months after the privatization, even if the national court passed an irrevocable decision on this case in 2001, saying the privatization was legal. Among the shareholders of SA Ipteh are a Romanian national, a British company and a Romanian company whose major shareholder is the current Prime Minister of Moldova Vlad Filat. Filat said earlier that the building owned by SA Ipteh was nationalized by order of the former head of state Vladimir Voronin and the move was aimed at intimidating the PLDM and its leader. Asked if the shareholders of Ipteh will demand damages or that the building be returned, Hanganu said that no decision was taken yet. According to the lawyer, the building is valued at about 750 million lei, but the sum would be larger if taking into account the dividends that the shareholders were to receive after the privatization of the building until present, as 10,000 square meters of space were to be leased out in central Chisinau.
