Fundamental rights should not be subject to referenda, civil society leaders

A group consisting of civil society leaders that promotes secularism is suggesting that the Election Code should be amended so as to ban putting up for referenda matters of fundamental rights. Nicolae Panfil, the Secretary of the Civic Coalition for Free and Fair Elections and a member of the group, has told a press conference at Info-Prim Neo that the Election Code in its current version doesn't contain explicit provisions banning specific matters from being put up for referenda. According to the group, it is also necessary that referendum proposals should be priorly subjected to legal expertise provided, for example, by the Constitutional Court or the Parliament's legal commission, so as to check the proposals for conformity with the Constitution. The recommendations of the group for the promotion of secularism have been submitted to the Parliament's specialized commission. The authors say the proposals should be considered despite the Election Code being already adopted in first reading, as the modifications wouldn't significantly alter the structure of the document.
