Judge who issued warrant for Braguta’s arrest dismissed

The Superior Council of Magistracy on January 16 accepted the challenges submitted by senior inspector judge Nicolae Clima and prosecutor general Eduard Harunjen against the decision of the Disciplinary Board and, by a unanimous vote, decided to dismiss judge Iurie Obada of the Chisinau Court of Law, who issued an warrant for the arrest of Andrei Braguta, IPN reports, with reference to a press release of the Superior Council of Magistracy.

It should be noted that on November 24, 2017, the Disciplinary Board of the Superior Council of Magistracy decided to drop the disciplinary proceedings against judge Iurie Obada. Senior inspector judge Nicolae Clima and prosecutor general Eduard Harunjen asked to adopt a new decision in relation to the judge, invoking the lack of legal reasons that would have justified the arrest in the case of Andrei Braguta.

Andrei Braguta was arrested on August 15 last year. The 32-year-old man was arrested after he got into a conflict with patrolling officers, who fined him for speeding. On August 26, the young man died in Pruncul penitentiary. The Prosecutor General’s Office said the man died from respiratory failure and purulent bronchopneumonia, while the bruises he had on the body were the result of the aggression of his cellmates, who said that Braguta had deviant behavior. Seven persons – three inspectors of the remand prison of the Chisinau Police Division and four detainees – were accused in this case. In two months, another 13 police officers of the remand prison were charged with using inhuman treatment against Barguta.
