Justice Ministry submits new proposal on specialized courts
The Ministry of Justice drafted a new legislation amendment proposal concerning the economic and military courts and submitted it for coordination as a matter of emergency, Info-Prim Neo reports.
According to a communiqué from the Ministry, the opportunity of adopting this bill in a short period of time is based on the Constitutional Court’s decision whereby the law with amendments to a number of legal acts providing for the liquidation of the specialized courts was declared unconstitutional.
The Ministry of Justice suggests restoring the provisions regarding the presence of the military and commercial courts in the law on the judicial organization as this way the category of cases that these courts are to manage is better defined.
It also proposed liquidating the Economic Court of Appeals, whose activity is not regulated by the constitutional provisions that stipulate that specialized courts can function in Moldova for certain categories of cases. The judges of these courts can be employed at other institutions, in accordance with the suggestions made earlier by the Supreme Council of Magistrates.
Besides, there will be made amendments to the Law on the Supreme Court of Justice, which will review the powers and composition of the boards that work within this institution, to the Civil Code, so as to specify the competence of the district commercial courts, and to the Penal Code.
