Justice Ministry to choose institution responsible for escorting convicts
The Ministry of Justice is to decide who is responsible for escorting convicts to hearings – the Ministry of the Interior or the Department of Penitentiary Institutions. The Supreme Council of Magistrates remitted the application filed by Minister of the Interior Alexei Roibu, whereby he asked solving the given problem, to the Ministry of Justice, Info-Prim Neo reports.
In his application, Alexei Roibu requested the Supreme Council of Magistrates to order that the judges do not make orders whereby the police commissariats are obliged to escort the prisoners to courts.
The minister makes reference to a Government Decision of 2008, which says that among the tasks of the Department of Penitentiary Institutions is to escort the convicts to courts and hand them over to the prosecution bodies.
On the other hand, the head of the Department’s Guard, Supervision and Escort Division Anatolie Falca said the police officers are obliged to escort the detainees as another Government Decision of 2004 says the Department of Penitentiary Institutions escorts the convicts only within the penitentiary system, to the Military Court, the Courts of Appeals, and the Supreme Court of Justice.
According to Anatolie Falca, the decision of 2008 does not specify which institutions should escort the detainees. He said that this is an older problem that the Ministry of Justice should deal with.
