Minor stays in psychiatric hospital for over three months out of mayor’s negligence

The mayor of Ciutesti village of Nisporeni district was convicted of professional negligence with serious consequences. By its decision, the Chisinau Appeals Court accepted the prosecutor’s request and the mayor was given a suspended sentence of two years and six months and banned from holding particular posts for a five-year period, IPN reports.

According to the Prosecutor General’s Office, the prosecution proved that in 2014, when serving as the guardian of a 16-year-old minor who remained without parental care, the mayor ordered to place the boy at the Clinical Psychiatric Hospital in Chisinau for three-week psychiatric treatment. Being repeatedly informed about the expiration of the treatment by the hospital’s administration, the mayor didn’t take measures to have the boy discharged.

Consequently, the boy groundlessly received psychiatric treatment at the given hospital for another 144 days. According to the prosecutors, by such actions the rights and interests of the minor were encroached upon and this can seriously affect his psychological-emotional state and can cause physical and mental pain.

Earlier, owing to the minor’s aggressive behavior, the ex-guardians refused to fulfill their duties and the boy was taken to a placement institution in Rezina. As the boy remained alone at the placement institution, the mayor ordered to administer psychiatric treatment to him.

After this was discharged, a relative of the boy accepted to take this under guardianship. The two are now abroad, where the relative works.

A similar case happened two years ago, when a minor stayed in the Psychiatric Hospital in Balti for eight more months that it was prescribed. Representatives of the Ombudsman’s Office identified this case during a working visit to the hospital.
