NGO asks President not to promulgate law on prosecution of judges
The Center of Initiatives and Monitoring of Public Authorities (CIMAP) nongovernmental organization request Moldovan President Nicolae Timofti not to promulgate the latest amendments to the Law on the status of judges, which allows criminal proceedings to be started without the Magistrates’ Superior Council (CSM), Info-Prim Neo reports.
According to CIMAP head Ion Dron, allowing the Prosecutor General, who is chosen and appointed by political criteria, to start criminal proceedings against judges without CSM’s agreement is an open and brutal attack on the independence and constitutional authority of this institution. Ion Dron thinks that the latest amendments operated by the Moldovan Parliament don’t correspond to the constitutional principles regarding the separation of powers in the state and regarding the judge’s independence in carrying out the act of justice.
“Once they come into effect, these law amendments will bring serious harm to the functional independence of justice in delivering justice and, as a result, to people’s rights and liberties”, said Ion Dron a press statement.
The initiative to amend article 19 of the Law on the status of judge was adopted by MPs at the end of the spring-summer session.
