Notaries will have to archive all cases examined by them
Notaries will be obliged to store all the cases examined by them in an archive. When a given notary stops working, this duty will be taken over by another notary working in the zone. The Government approved amendments to the law on the notary’s work on November 5, Info-Prim Neo reports.
Minister of Justice Vitalie Parlog said that the amendments were needed because the storing and release of information from the notary’s archive involves special rules designed to protect the personal data.
In order to guarantee the integrity of the notary’s archive, which is state property, article 20 of the law is extended by a paragraph, which says that the courts of law, the prosecutor’s office and prosecution bodies can make use of the archive only when they examine legal, civil or administrative cases with the aim of establishing if the notary document is investigated over forgery in public documents.
The other amendments concern the qualification level of notaries. Probationers will have the right to take the qualification exam only after three years of work. The candidates must have professional skills and irreproachable reputation.
The amendments also stipulate the duties of the Commission for Licensing Notaries and Setting up the Disciplinary Board and the conditions for suspending the notary’s license.
Under the amendments, the notaries are also empowered to carry out mediation.
Parlog also said that the approved changes will enable to adjust the existent legal framework to the European legislation.
